Criminal Case Management Appearances on or after November 30, 2020
The Ontario Court of Justice has released a new directive concerning the current practise of auto remanding matters.
The adjournment of criminal case management matters in the absence of the accused will end on Friday November 27, 2020. Commencing Monday November 30, 2020, accused persons will be required to attend for their scheduled case management court appearances either through counsel on their behalf, or by appearing personally by telephone or video.
For any accused persons who fail to attend a scheduled court appearance,. the Court has two options. The presiding judicial official may issue a bench summons requiring the accused person to attend court on a specified future date. The other option is for the presiding judicial official issue a bench warrant for the accused person's arrest, if the presiding judicial officer has reasonable and probable grounds to believe that it is necessary in the public interest to do so.
